This is an appeal from a trial court judgment granting a motion for summary judgment.

FACTS

On or about June 4, 1985, plaintiff, Tony Triplette, was employed as a laborer by Midwest Cooling Tower Services, Inc. (Midwest). Midwest had a contract with Exxon Corporation (Exxon) to repair its cooling towers at the Exxon Refinery in Baton Rouge.
