Defendant, Whitney Segura, was charged by bill of information with the crime of possession of marijuana with intent to distribute, a violation of LSA-R.S. 40:966(A)(1). On July 19, 1988, defendant was tried before a jury of twelve, which found him guilty as charged by a vote of ten to two.
