This case comes before the court on a writ of certiorari from the Rhode Island Public Utilities Commission (commission). In a declaratory judgment the commission ruled that G.L. 1956 (1984 Reenactment) § 39-1-30, which requires an appeal to the commission of ordinances and regulations affecting companies "under the supervision of the commission," does not apply to the respondents Rhode Island Cogeneration Associates, Newbay...
