The appellant was indicted by the Russell County grand jury for possession of marijuana, in violation of § 20-2-70, Code of Alabama (1975). The appellant was convicted in a jury trial of the offense charged, and he was sentenced under the Habitual Felony Offender Act to a term of 10 years' imprisonment. Two issues are raised on this appeal.
