SULLIVAN, Justice, for the Court:

Larry Anthony Whitehurst was convicted by jury in the Circuit Court of Tate County of culpably negligent manslaughter pursuant to Miss. Code Ann., § 97-3-47 (1972). Whitehurst was sentenced by the court to serve a term of twelve (12) years in the custody of the Mississippi Department of Corrections. Whitehurst has appealed to this Court assigning the following as error:
