On December 11, 1986 appellant, Kimberly Volkmann, was charged by bill of information with attempted forcible rape, a violation of LSA-R.S. 14:42.1 and 14:27. Appellant was found guilty as charged by a unanimous 12-person jury. Appellant was sentenced on April 5, 1988 to eight years at hard labor with the first year to be served without benefit of probation, parole or suspension of sentence.
