Darrell J. McIntire was convicted of theft, a class A misdemeanor in violation of Utah Code Ann. § 76-6-404 (1978), and possession of a controlled substance with intent to distribute for value, a second degree felony in violation of Utah Code Ann. § 58-37-8 (1987).
