DHRS v. BUTTIGLIERI

No. 88-1018.

539 So.2d 1185 (1989)

DEPARTMENT OF HEALTH AND REHABILITATIVE SERVICES, Etc., Appellant, v. Peter BUTTIGLIERI, Appellee.

District Court of Appeal of Florida, Fifth District.

March 23, 1989.

Attorney(s) appearing for the Case

Harold E. Barker, and Sheryl D. Snodgrass, of Carlton & Carlton, P.A., Lakeland, for appellant.

PER CURIAM.

AFFIRMED.

ORFINGER and COWART, JJ., concur.

SHARP, C.J., dissents with opinion.

SHARP, Chief Judge, dissenting.

I respectfully dissent. This case involves the power of a trial judge to overrule fact findings made by a General Master to whom a support matter was referred, and secondarily, the more prosaic question of his power to do so without any additional evidence having been presented to him.
