We grant appellee U-Haul Co.'s motion for clarification and withdraw the opinion of this court filed September 19, 1989, substituting the following in its place:

Scott McEvoy was injured while engaged in a fight with Jose Fonte, the owner of a service station which was also a U-Haul franchisee. Jose Fonte Lipcourt, Fonte's grandfather, who worked at the station, stabbed McEvoy during the course of the incident...
