In an endorsement of November 10, 1987, plaintiffs' common law fraud and Rule 10b-5 claims were dismissed without prejudice for failure to plead fraud with particularity as required by Fed.R.Civ.P. 9(b). Defendants Harrison M. Lasky and Lon B. Rubin now move to dismiss the entire complaint, on the grounds that the fraud claims of the amended complaint remain insufficiently particular, several fraud allegations fail to state a cause of action...
