OPINION ON REMAND

WEAVER, Chief Justice.

Appellant was convicted of robbery pursuant to TEX.PENAL CODE ANN. sec. 29.02(a)(1) (Vernon 1989), enhanced by two prior convictions, and was sentenced to thirty years confinement in the Texas Department of Corrections. On appeal, this court reversed upon the grounds of insufficient evidence and remanded to the trial court for a judgment of acquittal. Lane v. State, 713 S.W.2d 223
