MEMORANDUM OPINION

MICHAEL, District Judge.

Defendant Albemarle County brings its motion for summary judgment pursuant to Rule 56 of the Federal Rules of Civil Procedure. Defendant Charles William Hurt brings his motion to dismiss plaintiff's claims against him pursuant to Rule 12(b)(6) of the Federal Rules of Civil Procedure. For the reasons stated infra, the motions of both defendants are granted.
