OPINION ON APPELLANT'S PETITION FOR DISCRETIONARY REVIEW

CAMPBELL, Judge.

Appellant was convicted of capital murder. When the jury was unable to reach a verdict at the punishment phase, appellant was sentenced to life imprisonment. Art. 37.071(e) V.A.C.C.P. In a published opinion, the Texarkana Court of Appeals affirmed appellant's conviction. Wallace v. State, 707 S.W.2d 928
