HOUSTON, Justice.

The Birmingham Board of Education ("Board") cancelled the employment contract of Elizabeth Talley, a tenured teacher in its school system. Ms. Talley appealed to the Alabama State Tenure Commission ("Commission"), which reversed the Board's action and ordered that she be reinstated. The Board petitioned the Circuit Court of Jefferson County for a writ of mandamus compelling the Commission to vacate its order. The circuit court issued the writ. The...
