We are once again called upon to examine the problem of determining whether a party is a seaman or a longshoreman for purposes of applying either the Jones Act, 46 U.S.C.App. § 688, or the Longshore and Harbor Workers' Compensation Act (LHWCA), 33 U.S.C. § 901 et seq.
