This is a suit for declaratory judgment to decide the enforceability of a non-competition agreement between Norman L. Neal (Neal), plaintiff, and Superior Enterprises, Inc. (Superior), defendant. On cross motions for summary judgment, the trial court ruled Neal was not bound by the agreement.
