The plaintiff Omer D. Gibbs ("Gibbs") commenced this action against defendant Service Lloyds Insurance Company ("Service Lloyds") in the District Court of Denton County, Texas. Service Lloyds issued a policy of worker's compensation insurance to Gibbs' employer Dave Krause Pontiac-Toyota, Inc. ("Krause").
