The appeal was granted to test the action of the Court of Appeals in affirming the dismissal of plaintiffs' cause of action. According to the complaint, four residents of Henderson, Tennessee, died from smoke inhalation and asphyxiation on November 27, 1984, when a fire destroyed the home in which they were residing.
