Ricky Dean Perryman was indicted for the offense of burglary in the third degree in violation of § 13A-7-7(a), Code of Alabama 1975. The jury found the appellant "guilty as charged in the indictment" (R.241), and the trial judge sentenced the appellant to six (6) years' imprisonment in the penitentiary.
