This action arises from a suit for worker's compensation benefits. The trial court determined plaintiff/appellee, Blaine Babineaux (hereinafter Babineaux), was temporarily totally disabled and awarded him supplemental earnings benefits (SEB) for five hundred (500) weeks and found the appellants to have been arbitrary and capricious in failing to pay supplemental earnings benefits and ordered them to pay a penalty of 12% of the total amount of the claim...
