Dribeck Importers, Inc. (Dribeck) filed this case against G. Heileman Brewing Co., Inc. (Heileman), seeking recovery for costs incurred in the defense of lawsuits brought by former beer wholesalers against Dribeck. Dribeck claimed that Heileman breached its duty to defend and indemnify Dribeck against such wholesaler actions — a duty imposed pursuant to an earlier settlement agreement entered into between Dribeck and Heileman.
