The Court has before it an appeal from a criminal conviction imposed by the United States Magistrate. The Court heard oral argument on February 6, 1989, and the matter is now ready to be resolved. While the Magistrate's factual findings must be upheld unless clearly erroneous, his application of those facts to the law is reviewed de novo. See United States v. Feldman, 788 F.2d 544
