Plaintiff, Stanley Richards, appeals from the dismissal of his complaint for relief under C.R.C.P. 106(a)(4). We reverse.

Plaintiff was arrested on January 28, 1988, for driving while under the influence of intoxicating liquor, a misdemeanor under § 42-4-1202(1)(a), C.R.S. (1984 Repl. Vol. 17).
