HOWARD, Judge.

The Commonwealth appeals from a judgment of the Hardin Circuit Court vacating a criminal conviction on the grounds of ineffective assistance of counsel.

The appellee, Jerry Wesley Gilpin, was convicted of murder in December of 1981, for killing a man by stabbing him with a knife. As a result, appellant was sentenced to life in prison. The conviction was affirmed by the Kentucky Supreme Court. The victim's body was discovered between 8:00 and...
