The defendant, Charles Ray Kimble, was charged by grand jury indictment with second degree murder, in violation of LSA-R.S. 14:30.1. He pled not guilty and, after trial by jury, was found guilty of the responsive verdict of manslaughter, a violation of LSA-R.S. 14:31. He received a sentence of fifteen years at hard labor, without benefit of probation, parole, or suspension of sentence.1 The state filed a habitual offender...
