This is a DUI case. Following a conditional guilty plea, Daniel Thomas was convicted in the Magistrate Division of the District Court in Blaine County of driving while under the influence of alcohol. I.C. § 18-8004 (DUI statute). For this offense, Thomas was fined $750, he received a thirty-day sentence of which twenty-eight days were suspended, and his driving privileges were suspended for 120 days.
