OPINION

PAUL PRESSLER, Justice.

Appellant was convicted, by a jury, of driving while intoxicated. The court assessed punishment at one year confinement in the Harris County Jail probated for two years and a fine of $450.00. We reverse and remand for proceedings consistent with this opinion.
