GOLDEN, Justice.
In this summary judgment appeal we hold that the question whether a public employee, who allegedly engaged in intentional tortious conduct, was acting within the scope of his duties under W.S. 1-39-104(a) (June 1988 Repl.), was a question of fact for the trier of fact, not one of law for the court as was determined by the trial court.
