The plaintiffs were passengers in an automobile which was involved in an accident with an automobile operated by the defendant and third-party plaintiff. An action was thereafter commenced by them in the Supreme Court of New York, Chautauqua County. Pierce, thereafter, filed a Third-Party Complaint against William Rozumalski, the driver of the car in which the plaintiffs were passengers, and against General Motors...
