OPINION

KALITOWSKI, Judge.

Appeal is taken from the trial court's dismissal of appellant's action for declaratory judgment declaring respondent, State of Minnesota, obligated to indemnify respondent, Alberto O. Miera, as an employee of the state for the judgment against him. We affirm.
