The plaintiff, Waste Disposal Incorporated (WDI), seeks to construct and operate a solid waste disposal facility within the Town of Porter (Porter). In July of 1986, WDI submitted an application to the Porter Planning Board (Planning Board) for town review of its development plan under the Porter Land Use Ordinance in effect at the time.
