This appeal arises out of an automobile accident in which plaintiff allegedly sustained personal injuries. James Howell filed suit against Balboa Insurance Company seeking recovery in damages under provisions of his mother's uninsured motorist policy. American Home Assurance Company was also named as a defendant as the excess insurance carrier and the State of Louisiana, through the Department of Transportation and Development on a separate theory...
