This is a death penalty case. In 1987, Siebert was convicted, pursuant to Alabama Code 1975, § 13A-5-40(a)(10), of the capital murder of Sherri Weathers and her sons, Chad and Joseph. The relevant facts surrounding the petitioner's crime and conviction are set forth adequately in the Court of Criminal Appeals' opinion, 555 So.2d 772, and need not be restated here.
