GRANT, Justice.

This is an appeal from the district court for Red Willow County. The defendant-appellant, Cecil M. Byrd, was charged by information with distributing, delivering, or dispensing marijuana in violation of Neb. Rev.Stat. § 28-416(1)(a) (Reissue 1985), a Class III felony.
