This case comes before us on the defendant's appeal from a judgment of conviction for the robbery of a Cumberland Farms store on October 11, 1982. The conviction now pending on appeal resulted from the third trial of this defendant, Raymond DeBarros. The first trial was terminated when the jury was unable to agree on a verdict.
