MEMORANDUM OPINION

COHILL, Chief Judge.

Presently before us is plaintiff's Motion for a New Trial pursuant to Federal Rule of Civil Procedure 59(a). For the reasons stated below, we will deny plaintiff's motion.

I. BACKGROUND
