This workers' compensation suit was filed by the worker's compensation insurance carrier for Service Construction Company, the employer of the defendant.

The complaint alleged that on 3 July 1986 defendant was hired by Service Construction Company to perform heavy construction work. Defendant certified that he had no previous back injury and that he did not have any physical condition which would limit his ability to perform...
