Appellant Duane H. Gillman is the trustee of the bankruptcy estate of West America Credit Corporation and West America Thrift and Loan (cumulatively "West America"). Gillman brought a negligence action against the Department of Financial Institutions of the State of Utah ("the Department"), claiming that by reason of the Department's failure to properly regulate West America, the investors lost their investments in the two West America corporations...
