Defendant, Shelter Mutual Insurance Company, appeals from the judgment entered on a jury verdict in favor of the plaintiff, Winnie Tam, on her breach of contract claim under the terms of Colorado's no fault statute. The jury found that the defendant's failure to pay benefits was wilful and wanton, and the trial court awarded treble damages and attorney fees.
