Defendant, Elmore D. Wheatley, was charged with three counts of armed robbery, each violation allegedly occurring on a different date. He was tried by jury and convicted of Count 3 which had been severed. Subsequently adjudged a second felony offender by the court, he was sentenced to 33 years imprisonment at hard labor without benefit of probation, parole or suspension of sentence.
