Appellant, Donald R. Johnson, and Anthony L. Glassco were jointly indicted in a two-count indictment for the crime of theft of property in the first degree, in violation of § 13A-8-3, Code of Alabama 1975. The cases were severed on motion of the state, and appellant Johnson was tried and convicted of the offenses as charged. Glassco testified at trial as a state's witness against Johnson.
