The State appeals from the circuit court's order dismissing defendant's indictment for delivery of a controlled substance (Ill. Rev. Stat. 1985, ch. 56 1/2, par. 1401(c)), arguing that the circuit court erred when it determined that defendant's statutory right to a speedy trial had been denied.

On January 20, 1987, defendant was arrested for possession of a controlled substance...
