ASPEN, District Judge:

Claimant Jeff C. Levin moves to dismiss the United States' complaint for forfeiture of his 1988 Ford Mustang automobile under the provisions of 21 U.S.C.A. § 881(a)(4) (West 1981 & Supp.1988). Levin contends that such forfeiture violates the proportionality of punishment requirement of the Eighth Amendment of the United States Constitution.
