Appellee Commonwealth Mortgage Corporation [Commonwealth] brought this action against Woodcrest Associates, Ltd. [Woodcrest] to secure possession and control of an apartment complex which Woodcrest had pledged as security for a loan. Woodcrest filed a counterclaim against Commonwealth seeking penalties for usury.
