Defendant, Chester Bennett, Sr., was charged by bill of information with driving while intoxicated, third offense, in violation of La.R.S. 14:98. On May 13, 1987, a jury of six unanimously found defendant guilty as charged. Prior to sentencing, the State filed a habitual offender bill, pursuant to La.R.S. 15:529.1.
