McMILLAN, Judge.

In May 1987, the appellant was indicted by a Mobile County grand jury for the sale of marijuana, in violation of § 20-2-70, Code of Alabama (1975). In January 1988, the appellant was found guilty in a jury trial, and was fined $1,000.00. Upon completion of a presentence investigation, the appellant was also sentenced to a term of ten years' imprisonment in the State penitentiary.
