KNOLL, Judge.

Defendant, Phillip A. Jones, appeals his conviction for possession of marijuana with the intent to distribute, a violation of LSA-R.S. 40:966 A (1). After waiving his right to a jury trial, defendant was found guilty as charged in a bench trial, and was sentenced to serve five years at hard labor, suspended, and placed on five years active probation subject to numerous conditions, including that he serve one year in the parish prison, pay a $1500 fine...
