COOPER, Justice.

This is a malpractice action against an attorney. The trial judge dismissed the action on motion for summary judgment. The Court of Appeals reversed, finding that the action was filed timely, and that there was a genuine issue of fact concerning the applicable professional standards under the circumstances of this case.
