This action arises out of a collision between a truck driven by plaintiff, Kerry Jones, and a train owned by defendant, Missouri Pacific Railroad Company (Mo-Pac). Plaintiff filed suit for damages against MoPac and Union Pacific Insurance Company, the plaintiff's uninsured motorist insurance carrier. Union Pacific was subsequently dismissed with prejudice from the suit. After a trial on the merits, the trial court found the defendant to be 60% at fault...
