This is a suit on a promissory note. Plaintiff James R. Graves, as Liquidator of Performance Motor Sport Service, Inc. (PMSS), payee of the note, brought suit against defendant, John W. Porterfield, maker of the note. Mr. Porterfield answered the suit alleging failure of consideration and asserting the exception of no right of action.
